TRALA seeks ELD exemption until the end of 2018

The Truck Renting and Leasing Association (TRALA) has recently asked the Federal Motor Carrier Safety Administration to extend its ELD mandate exemption until the end of 2018.

On January 19, the FMCSA granted TRALA a 90-day exemption from complying with the ELD mandate. The waiver was for trucks rented for 30 or fewer days. As per the ELD mandate extension granted by the FMCSA, the exemption would expire on April 19, 2018.

According to the latest notice of application for exemption, TRALA said that the first 90-day exemption period “is not sufficient to address the ELD problems that they and their short-term lessors are encountering.”

This request, if granted, would provide rental-vehicle owners, carriers, and drivers with additional time to develop compliance strategies for dealing with the unique issues relating to the use of ELDs in short-term rental vehicles.”

TRALA also said that if the waiver extension request is granted, it “would not have any adverse impacts on operational safety, as drivers would continue to remain subject to the hours-of-service regulations as well as the requirements to maintain a paper record of duty status.”

The FMCSA sought comments from the public on TRALA’s latest request. Those who want to comment can click here. The commenting period will run until April 12.

Full enforcement for non-exempt drivers

On the other hand, April 1 marks the beginning of full enforcement for non-exempt drivers.

After April 1, non-exempt drivers without compliant ELD solutions will be placed out of service for 10 hours. ELD violations will also affect carriers’ CSA scores. The FMCSA has recently detailed the return-to-duty procedures for drivers.
